The treatment of the dignity and human cloning
in the Argentinean Law system
Santiago Gabriel Calise1
Abstract:
The following paper deals with the relation between human dignity and human cloning,
in the Argentinean law system. It is not a local particularity, but an international
tendency, to resort to human dignity in order to prohibit human cloning, both in its
therapeutic and its reproductive form. The aim here is to observe if this relationship is
really useful to argue for a prohibition of this practice. So to find out this statement,
juridical doctrine texts will be analyzed, at the same time that jurisprudence will be
studied in order to ascertain how human dignity concept was utilized. In this way, it will
be possible to establish if that category can found a prohibition.
Keywords: legal doctrine, jurisprudence, Luhmann, genetics, Kant.
